Terms of Service
These Terms and Conditions (“Terms”) govern your use of danaleko.com and related services (“Services”) provided by (“Company”). By accessing or using our Services, you agree to comply with and be bound by these Terms.
Our services
We offer professional branding, graphic design, web design, and web development services. This includes creating brand identities, marketing materials, and responsive websites that help businesses grow and communicate effectively online.
Client Responsibilities
To keep every project running smoothly, we ask our clients to:
Share accurate and complete information related to the project.
Provide timely feedback and approvals to help us stay on schedule.
Make payments as outlined in the invoice or project agreement.
Grant danaleko.com permission to use provided logos, content, and materials solely for the project.
Payment Terms
To commence any project, a 60% non-refundable deposit is required upfront. This ensures your commitment and allows us to allocate the necessary resources to your project. The remaining 40% is payable upon project completion, defined as when all agreed deliverables have been provided to the client.
We accept payments via bank transfer, mobile money (M-Pesa – For clients in regions where Mpesa is available).
Late Payments
Final payment must be made within 2 days of project completion. If payment is not received within this period:
- We reserve the right to withhold all deliverables, including files, access to design assets, or website transfer.
- The project may be considered canceled if the delay extends beyond 7 days without communication, and any future engagement will require full upfront payment.
- A late fee of 27% may be applied for overdue invoices.
Custom Payment Plans
For larger projects, we offer custom payment plans to meet your budgetary needs. These must be agreed upon in writing before the project begins.
Refund Policy
All payments made to danaleko.com are non-refundable. Since our services and deliverables are digital in nature, they cannot be returned or exchanged once delivered or work has commenced. For this reason, no refunds will be issued under any circumstances, including project cancellations or changes of mind.
Project Timelines
Project timelines will be discussed and agreed upon before commencing. Delays may occur due to:
- Requests for changes or additional features beyond the initial project scope. These changes may impact the final delivery date, and additional fees could apply.
- Client inaction, such as failure to provide necessary content, feedback, or approvals within agreed timelines.
Intellectual Property
Upon receipt of full and final payment, ownership of the completed design and development deliverables shall transfer to the client. This transfer includes, but is not limited to, the finalized website design, front-end and any other deliverables explicitly outlined in the project scope.
Unless exclusive rights are purchased separately, danaleko.com retains the right to include a “Developed by Danaleko” credit in the website footer or other suitable location. The removal of this credit is subject to a separate fee agreed upon prior to project commencement.
danaleko.com reserves the right to display completed projects, in whole or in part, within its portfolio, case studies, and marketing materials unless the client expressly requests otherwise in writing.
Ownership of Source Files
All original source files, including but not limited to layered PSDs, AI files, Figma files, and original code repositories, remain the sole property of danaleko.com unless otherwise specified in the project agreement.
Should the client require access to these source files, a separate licensing or transfer fee will be negotiated based on the nature and scope of the project.
Project Terms
We reserves the right to suspend or terminate any ongoing project under the following circumstances:
Failure to make payments in accordance with the agreed terms
Breach of any conditions outlined in this Terms of Service document
Any form of abusive, disrespectful, or inappropriate conduct during communication or collaboration
In the event of termination due to client default, all payments made shall remain non-refundable. We also reserves the right to withhold all deliverables and associated materials until any outstanding balances are settled.
